A. All Members of the Association (or their designated tenants) are authorized to use the swimming pool facility. This privilege may be suspended by the Board for Members who are delinquent in their assessment payments for a period in excess of sixty days or who have received a legal notice. Members who lease Lots must designate, in writing, using a form authorized by the Association, that those tenants living in the Lot who are entitled to use the swimming pool. A non-resident Member who leases a Lot/residence is not entitled to use of the swimming pool facility if they have given their access to their tenants.
B. Facilities digital pass will be issued to all Members,
members of their immediate families residing
in the Lot permanently, and designated tenants of Members, aged two years and older. A facilities pass will not be issued to
any Member or other eligible pool user unless
all assessments or other charges owed to the Association are not sixty days
past due or when a legal notice has been sent.
Only those people with a valid facilities pass shall be entitled to use
the swimming pool facilities. Facilities passes will be issued or validated on an
annual basis prior to the beginning of the swimming season.
C.
Digital passes will only be issued to those who are legally residing
at the address. The
Association reserves the right to require proof of residency. Proof of Residence can be provided from
the following: State, or government issued ID, Vehicle Registration, statement
from Utilities, Cellphone, Cable, Insurance or another regular bill that
show full name and address.
D. Facilities digital
passes are the property of the Association and are for the exclusive use of
residents of New Bristow Village. The passes are not transferable and may be
suspended by the Association for violations of the Association governing documents or rules and regulations, as well
as improper conduct with respect to the use of the swimming pool facilities,
as referenced in Part II, below.
E. All guests must enter
with the resident and register with the pool staff prior to entering the pool. The conduct of guests is the responsibility of
the resident they are with.
F. All guests must leave with the resident
they came with. No guests,
regardless of age can use the pool without being with a
resident.
G. The Board may, from time to time, establish rules with respect to guest
privileges, including the number of guests
that may be admitted and fees, if any, for such guests.
All Members of the Association, their tenants, guests, and invitees shall
be deemed to have indemnified and agreed to hold the Association and each Owner free and harmless from any loss, claim, or liability of any
kind or character whatever arising by reason of using the Association swimming
pool.
H. The Household
(regardless of the number
of residents) will be issued 10 guest passes per pool
season. These passes are not transferable to other residents or households. Once these passes have been used, the resident can
purchase more from management in a group of 10. Guest passes are only good for one season, they do not carry
over if unused, regardless of when additional were purchased.
The Association reserves the right
to adjust as needed during
a pool season.
i. All passes
must be purchased during office hours in the management office.
Pool staff and/or Lifeguards
will not have this ability or access.
I . Purchases of additional pool guest passes
will be charged
to your HOA
account.
i. Charges
for Guest Passes can and will count towards delinquencies if left unpaid, once
the charge has been applied to their account a notification will be sent via email to the homeowner.
J. No Household is allowed to use more than 4 guest
passes per visit or per day. Residents
are allowed to bring guests depending on their age as follows:
i.
Adult residents 18 & older
can bring the maximum of 4 guests
per day.
ii. Residents 12 to 17 can bring up to 2 guest with them per
day.
iii. Residents under 12
are not permitted to bring guests and must be accompanied by their
parent, adult sibling or legal guardian.
K. All residents and their
guest must check and in and out of
the pool for each visit. Whether
through the CellBadge app on their phone or with the gate attendant.
L. Residents who do not have their Picture
uploaded in the Pool Pass system, must show a picture ID issued by State, Government or School. Entry will not be allowed
to enter without
ID, no exceptions will be made.
A.
Managers and
lifeguards, have been instructed in the
rules for use of the swimming pool facility. Any conflicts shall be addressed with the management and lifeguards, who will bring
the issue to the Board if the issue cannot be satisfactorily resolved.
B.
Certified
lifeguards are always on duty when
the pool is open. Lifeguards
have the authority to enforce rules in order to maintain a safe and
healthy environment. The lifeguards are
in charge of the pool and are there for the protection of persons using the pool.. Management and or lifeguards have authority to ask anyone
to leave the pool area for infractions of the rules or when safety is
threatened.
C.
Management may
prohibit entry to anyone for up to one week for each violation without prior
authorization from the Board. If a second violation
occurs, pool restriction will remain in place until a board hearing takes place. Pool rules will be posted in an
appropriate place for all to be informed and can be found in the HOA
portal.
D.
Safety is the primary
concern of the Association and its Members. All people using the pool
do so at their own risk and agree to abide by the rules for use of the
facility. The Association assumes no responsibility for any accident or injury
in connection with such use or for any loss or damage to personal property.
Residents and or tenants are responsible for the actions of their guests and
members of their household.
E.
No person
shall use the pool facilities unless the pool is officially open and lifeguards are on duty.
Unauthorized persons found inside the pool enclosure when the pool is closed
will lose privileges for the remainder of the summer and risk prosecution for
trespassing.
F.
All swimmers
are encouraged to take a shower
using soap and warm water and thoroughly
rinse off before entering the pool. (Escorts are encouraged to instruct guests).
G.
Persons who have obvious
infections (colds, lesions, open sores, etc.) are not allowed
in the pool. Sanitary habits are a responsibility of everyone and
anyone displaying improper behavior will
be asked to leave the pool area.
H. . Smoking is strictly prohibited in the pool area or clubhouse facility. This also includes vaping. The pool area is defined as the
area inside the pool boundary fence.
I.
Food and non-alcoholic beverages are permitted in the pool area, but users are responsible
for clean-up. (Glass
containers are not allowed, see subsection K. regarding breakable objects).
J.
Alcoholic beverages
are strictly prohibited in the pool area and pool building.
K.
Breakable objects
(glass bottles or any glass objects) are not permitted in the pool area.
Plastic or paper items are acceptable.
L.
Any type of
intoxicating substance will not be allowed in the pool area. Intoxicated
persons are not allowed in the pool area at any time. Any persons discovered to
have any alcoholic beverage or other type of intoxicating substance will be immediately removed from the pool and pool area.
M.
Swimmers must wear proper bathing attire suitable for
a family setting. No cut-offs, thongs,
dungarees(jeans)
or similar attire
are permitted. Swimming
in street clothes
is strictly prohibited. Loose threads on swimwear that
could clog filters and pumps are not permitted.
N.
Persons must stay clear of the lifeguard observation area at all times so as not to block view.
O.
No children
under 12 years of age, regardless of swimming ability, are allowed in the pool
area
without parent or responsible guardian 16 years or older. Responsible guardian
16 year of age can accompany maximum of 2 (two) children under 12 years of age.
Parent, or responsible guardian, must watch their
children closely whenever they are near or in the water, regardless of their
age or swimming ability, and be always in control of children.
Non-swimmers must
be accompanied by a parent or responsible guardian in the water with them
within arm's reach.
P.
No non-swim
play equipment, play pens, wheeled
vehicles (except wheelchairs, strollers, etc.) are not permitted in the pool area.
Q.
No pets are permitted in the pool area with the exception of service animals.
R.
Because artificial flotation devices may
interfere with or disrupt the lifeguard's view of the water or may provide a
false sense of security for the user, they are prohibited from use. Prohibited
items include but are not limited to: inner tubes bigger than 24" in any
dimension, rafts of any kind, inflatable balls of any size, water guns in any
dimension, street balls (football, basketball, soccer ball, etc.) of any size
and kind, and non-Coast Guard approved water wings and life jackets.
Exceptions:
If a pool patron requires the assistance
of a flotation device as an aid for a qualified disability, that patron must
notify the Pool Manager on duty of the need for such a device upon each visit
to the pool.
Noodles, kick boards (for instructional
swimming only), diving sticks and soft balls designed for water play are
allowed. Users of those items may be
required to pass swim test at the Lifeguard's discretion to be allowed to use
them.
S.
Running,
pushing, wrestling, dunking, excessive splashing, standing or sitting on
another's shoulders is prohibited. No
screaming, profanity, or other boisterous behavior will be permitted in the pool area or pool building. After 2 warnings of non-compliance,
Lifeguards will ask the offender and possibly the family to leave. Names will be provided to management.
T.
Swimmers shall remain clear of the ladders and stairs except when entering or exiting the pool. Swimmers should not swing
or hang on stair railings and ladders. Stairs are not to be uses at seating.
U.
All trash must
be placed in containers provided
for this purpose.
Keeping the swimming
pool facility clean is everyone's responsibility.
V.
Incontinent users and non-toilet trained individuals are permitted to use the pools, provided they
are wearing appropriate waterproof undergarments.
W.
During the last fifteen minutes of every hour,
or as otherwise stated in Pool Management Contract, the pool will be designated for lap swimming and lap walking.
Lap Swimming Only once per hour for 15
minutes. Lap Swimming is actively moving from one side of the pool to the other
either swimming or walking. No sitting on the edge of the pool with feet in the
pool will be allowed. This requirement may be waived at the
discretion of the lifeguard staff.
X.
The pool may be closed at the discretion of the lifeguards in case of thunder, lightning, rain, temperature, ,Air quality ( quality index on
www.airnow.gov website is 200 or more), operational breakdown, or for swimmers
refusing to leave when requested to.
Y.
The use of any personal electronic devices is permitted when used with headphones so as
not to disturb others that are enjoying the pool area. Waterproof headphones are permitted as long as they do
not interfere with hearing commands from lifeguards.
Z.
Gum use is not allowed
while swimming in the pool or on the pool deck.
AA. Eating is allowed only in seated
areas. Eating is not allowed
within 3 feet of the pool edge. This also included the wadding
pool.
BB. The wadding
pool is for those 4 years and under
only and must be constantly monitored
by a competent swimmer.
CC. The
wadding pool is not for use during break time by anyone older than 4 years of
age.
DD. Private, reserved
use of the pool facility
is not permitted. Resident
may not hold parties
or other large gatherings at the pool.
